DUTIES OF THE STATE <br />BOARD OF TRUSTEES, <br />(a) The board shall employ the certified public <br />accountant, the actuary, and the investment <br />advisors for the fund, <br />(b) The board shall establish rules and <br />regulations necessary for the administration of the <br />fund, <br />(c) The board shall hear appeals from the <br />commissioner's decisions. <br />(d) The board may authorize a cost-of-living <br />increase for any benefit provided in the pension <br />system. If benefits are increased, the board may <br />require an increase in the governing body's <br />contributions to maintain the actuarial soundness <br />of the fund, <br />(e) The board shall give notice and hold a <br />hearing before authorizing a cost-of-living increase <br />in benefits, <br />(I) Any cost-of-living increase in benefits is <br />effective after approval by the legislature by <br />cO/Hent resolution, <br /> <br />v::'::~_E_CTION 22. LOCAL BOA R D OF <br />TR USTEES, <br />(a) The local hoard of trustees is composed of <br />the following: ( I ) one representative selected by the <br />governing body; (2) five memhers of the local fire <br />department chosen by a majority of fire fighters in <br />qualified service; and (3) two tax-paying voters who <br />are chosen by the other members of the board, <br />(b) The local board shall elect a chairman from <br />the members at the first meeting. <br />(c) Trustees serve two-year terms. <br /> <br />14 <br /> <br />. <br /> <br />(d) On the first local board. the fire department <br />representatives shall serve staggered terms, The fire <br />department representatives shall draw hy lot at the <br />first board meeting to determine the length of term <br />to be served. Three representatives shall serve two- <br />year terms, and two representatives shall serve one- <br />year terms, The first appointments of the tax- <br />paying or citizen representatives shall be one <br />appointed for a two-year term and one appointed <br />for a one-year term, Thereafter. all appointments <br />are for two-year terms, <br />(e) If a vacancy occurs on the board, it is filled <br />for the remainder of the unexpired term by the <br />procedure by which the position was originally <br />fi lied, <br />(I) A majority of board members constitute a <br />quorum, <br />(g) A board decision is made by majority vote of <br />all members present. The vote must be recorded in <br />the minutes of board meetings, <br />(h) No member of the local board may receive <br />compensation for service as a trustee, <br /> <br />SECTION 23, DUTIES OF THE LOCAL <br />BOARD OF TRUSTEES, <br />(a) The local board of trustees shall collect all <br />governing body contributions at least semiannually <br />and send the contributions to the commissioner, <br />(b) The local board shall hear and decide all <br />claims for benefits according to the procedures in <br />Section 7 of this Act. <br />(c) The board shall mail a copy of a decision on <br />a claim to the parties involved and to the <br />commissioner, <br />(d) The hoard shall keep complete records of all <br />claims and proceedings. <br />(e) The local board shall require a fire fighter <br />who is receiving temporary disability benefits to file <br />a disahility rating report from a physician every <br />,three months, The board may choose the physician. <br />When the reports indicate a significant change of <br />condition, the local board. after notice and a <br />hearing. must enter an order to modify or terminate <br />henefit payments, The order is sent to the <br />commissioner, If the board terminates benefits. the <br />fire fighter is presumed able to resume regular <br />employment duties. <br /> <br />15 <br />
