Mr. Garcia is apparently asking for utilities to his proposed building site at lots 11-20 block 159. This site is within 200 feet of sanitary sewer service. Section 26-3 (a) of the Code of Ordinances states the following: . . (a) REQUIRED SEWER CONNECTIONS. Any owner, agent or occupant of any property located within two hundred (200) feet of any street or alley or of any lot or tract of land abutting upon any street or alley along which extends any sewer or system of sewerage collection previously constructed or which may be hereafter constructed by the city, who shall construct, keep, maintain, use or permit to be used upon such property or premises any water closet, privy, sink, drain or other receptacle of sewerage not duly connected with such city sewer or sewerage collection system so that its contents are made to empty into such sewer or system of sewerage collection, shall be guilty of a misdemeanor. . . . . The current Utility Extension Agreement requires that the owner pay for the total actual cost of utility extensions. This requirement is outlined in section (5) of the Extension Agreement. . Subject to the provisions of this agreement, City hereby agrees to the construction and installation of said installation of utility main(s) according to the plans and specification to be prepared by the Owner's engineer and approved by the City. Upon completion and approval of plans and specifications City will place the project for bid. When bids are received they shall be tabulated by the City and a copy of said tabulation shall be provided to City and Owner. Thereafter, Owner shall deposit with the City in escrow a sum equal to the amount by the lowest responsible chosen bidder, plus a sum equal to the estimated construction staking and inspection fees if applicable. When said deposit has been made by Owner, City shall authorize construction of said extension(s). It is agreed and understood that the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs/or cost overruns in the project that result from circu~stances beyond the control of the City.
