DATE: 5/3/84 <br />. <br /> <br />. <br /> <br />Listed below are excerpts of the city's requirements for utilities. <br />Mr. Garcia is apparently asking for utilities to his proposed building <br />site at lots 11-20 block 159. This site is within 200 feet of <br />sanitary sewer service. Section 26-3 (a) of the Code of Ordinances <br />states the following: <br /> <br />. <br /> <br />. <br /> <br />(a) REQUIRED SEWER CONNECTIONS. Any owner, agent or occupant of <br />any property located within two hundred (200) feet of any street <br />or alley or of any lot or tract of land abutting upon any street <br />or alley along which extends any sewer or system of sewerage <br />collection previously constructed or which may be hereafter <br />constructed by the city, who shall construct, keep, maintain, use <br />or permit to be used upon such property or premises any water <br />closet, privy, sink, drain or other receptacle of sewerage not <br />duly connected with such city sewer or sewerage collection system <br />so that its contents are made to empty into such sewer or system <br />of sewerage collection, shall be guilty of a misdemeanor. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />The current Utility Extension Agreement requires that the owner pay <br />for the total actual cost of utility extensions. This requirement is <br />outlined in section (5) of the Extension Agreement. <br /> <br />. <br /> <br />Subject to the provisions of this agreement, City hereby agrees to <br />the construction and installation of said installation of utility <br />main(s) according to the plans and specification to be prepared by <br />the Owner's engineer and approved by the City. Upon completion <br />and approval of plans and specifications City will place the <br />project for bid. When bids are received they shall be tabulated <br />by the City and a copy of said tabulation shall be provided to <br />City and Owner. Thereafter, Owner shall deposit with the City in <br />escrow a sum equal to the amount by the lowest responsible chosen <br />bidder, plus a sum equal to the estimated construction staking and <br />inspection fees if applicable. When said deposit has been made by <br />Owner, City shall authorize construction of said extension(s).
