<br />e <br /> <br />e <br /> <br />-2- <br /> <br />To minimize prolonged business interruptions; <br /> <br />To minimize damage to public facilities and utilities such as water and gas <br />mains, electric, telephone and seVJer lines, streets and bridges located in <br />flood plains; <br /> <br />To help maintain a stable tax base by providing for the sound use and de- <br />veloprent of flood-prone areas in such a manner as to minimize future flood <br />blight areas; and <br /> <br />To insure that potential buyers are notified that property is in a flood <br />area; and <br /> <br />WHEREAS, in order to accomplish its purposes, the City Council of the City of <br /> <br />La Porte deems an Ordinance necessary which uses the following rrethods: <br /> <br />Restrict or prohibit uses that are dangerous to health, safety or property <br />in tirres of flood, or cause excessive increase in flood heights or <br />velocities; <br /> <br />Require that uses vulnerable to floods, including facilities which <br />serve as such uses, be protected against flood damage at the tirre of <br />initial construction; <br /> <br />Control the alteration of natural flood plains, steam channels, and <br />natural protective barriers, which are involved in the accarmodation of <br />flood waters; <br /> <br />Control filling, grading, dredging and other developrent which may in- <br />crease flood damage; <br /> <br />Prevent or regulate the construction of flood barries which will un- <br />naturally divert flood waters of which may increase flood hazards to <br />other lands. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. ARTICLE ONE. STATUTORY AUTHORI ZATION, FINDIt\GS OF FACT, PURPOSE <br />AND METHOD <br /> <br />SECTION A. STATUTORY AUTHORIZATION <br /> <br />Tha legislature of the State of Texas has in <br /> <br />delegated the <br /> <br />responsibility to local goverrnnental units to adopt regulations designed to minimize <br /> <br />flood losses. Tharefore, the City of La Porte, Harris County, Texas, does ordain as <br /> <br />follows: <br /> <br />SECTION B. FINDINGS OF FACT <br /> <br />{l} '!be flood hazard areas of La Porte are subject to periodic inundation which <br /> <br />results in loss of life and property, health and safety hazards, disruption of can- <br /> <br />merce and goverrnrental services, and extraordinary public expenditures for flood <br /> <br />protection and relief, all of which adversely affect the public health, safety and <br />
