Payment shall be based on the number of cubic <br />yards of municipal trash/rubbish delivered to Hughes under the terms of <br />this Agreement, it being further specifically understood and agreed by <br />and between the parties, with respect to the aforesaid compensation <br />that the compensation to be paid will be based upon predetermined <br />refuse truck capacities which are agreed upon between Hughes and City. <br />V. <br />HOURS OF OPERATION <br />Hughes agrees to maintain the landfill site, the subject of this <br />Agreement, open to the City on the following schedule: <br />Monday through Friday <br />Saturday <br />Sunday <br />7:00 a.m. to 6:00 p.m. <br />7:00 a.m. to 5:00 p.m. <br />8:00 a.m. to 5:00 p.m. <br />except Thanksgiving and Christmas, which shall be holidays and not <br />subject to the referenced schedule. <br />Hughes further and specifically agrees that it will use its best <br />efforts to maintain all roads and entrance to the site accessible and <br />in a good state of repair. <br />VI. <br />TERM <br />The initial term of this Agreement shall be for three (3) years, <br />beginning October 1, 1986, or upon earlier execution by both parties <br />hereto, and ending September 30, 1989• <br />VII. <br />INSURANCE AND INDEMNIFICATION <br />(A) Hughes agrees to furnish the City with certificates of <br />insurance evidencing that Hughes maintains public liability insurance <br />in the amount of at least One Hundred Thousand Dollars ($100,000.00) <br />for personal injury and property damage.
