<br />I, KARL JOHNSTON, Trustee, owner of Lots One (1) through Thirty-
<br />Two (32), inclusive, Block One Thousand One Hundred Six (1106), Town
<br />of La Porte, Harris County, Texas, for and in consideration of the
<br />vacation, abandonment, and permanent closing by the City of La Porte,
<br />a municipal corporation of the State of Texas, of the right-of-way
<br />lying between Lots One (1) through Sixteen (16), and Lots Seventeen
<br />(17) through Thirty-Two (32) , Block One Thousand One Hundred Six
<br />(1106), Town of La Porte, Harris County, Texas, do, for myself, my
<br />beneficiaries, any executors, administrators, assigns, or successors
<br />in interest, remise, release and forever discharge the City of La
<br />Porte, and. its successors, of and from all manner of action and
<br />actions, cause or causes of actions, suits, debts, sums of money,
<br />dues, claims, or demands whatsoever in law or in equity, which I, my
<br />beneficiaries, or successors in interest have ever had, now have, or
<br />will have against said city, by reason of cause or thing whatever,
<br />occuring in relationship to the abandonment of the aforedescribed
<br />right-of-ways, whether the same be upon contract or upon tort.
<br />
<br />Without limiting the generality of the foregoing, this release
<br />specifically applies to the existance of a four inch (4") water line in
<br />the aforedescribed right-of-way being abandoned by the City of La Porte.
<br />I, my beneficiaries, and successors in interest, understand that said
<br />water line exists, that it has been abandoned and capped,' and that
<br />the removal of said water line, or any damages accruing or occurring
<br />due to the existence of said water line in said abandoned right-of-
<br />ways, occur at my, my successors in interest or beneficiaries' risk.
<br />
<br />In addition, I, my beneficiaries or successors in interest
<br />understand that if water, waste water, or other utilities of the City
<br />of La Porte are to be furnished to said property, that same shall be
<br />at my, my successors in interest or beneficiaries' expense, and that
<br />all City of La Porte standard policies regarding the provision of
<br />utilities to said property shall apply.

<br />Before me, the undersigned authority, on this day personally
<br />appeared KARL JOHNSTON, Trustee, known to me to be the person whose

<br />therein expressed, in the capacity therein stated.
