~ ~ ORDINANCE NO. 1555 AN ORDINANCE AUTHORIZING THE MUNICIPAL COURT TO COLLECT A SPECIAL EXPENSE FOR SERVICES PERFORMED ON DISMISSED CASES; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Pursuant to the Provisions of Article 45.06, Texas Code of Criminal Procedure, the City Council of the City of La Porte hereby authorizes the City of La Porte Municipal Court to collect a special expense for services performed in cases in which the laws of this State require that the case be dismissed because of actions by or on behalf of the defendant which were subsequent to the date of the alleged offense. Such actions are limited to compliance with the provisions of Subsection (a), Section 143A, Uniform Act Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil Statutes). The City Council of the City of La Porte finds that the actual expenses incurred for the services in such cases is in excess of $10.00, and the Municipal Court is authorized to collect a special expense of $10.00 in each such case. Section 2. The special expense may be collected for offenses committed on or after September 1, 1987. Section 3: The City Council officially finds, determines, re- cites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3: This Ordinance shall take effect September 1, 1987.
