Williamson, Administrative Hearing O~~icer SUBJECT: Sweet Pea's Po Boy and Sandwich Shop - Ord. No. 1000-p Violatior A fact-finding hearing was held March 18, 1987 concerning allegation of violation of La Porte City Ordinance #1000-P by the above reference establishment pursuant to my authority as Administrative Hearir: Officer for the Ci ty of La Porte. The Honorable John Armstrong an Honorable Robert Montgomery represented the Ci ty of La Porte in th hearing. The Honorable Walter P. Mahoney, Jr. represented "Sweet Pea' Po Boy and Sandwich Shop ". Wi tnesses were sworn and testimony wa taken. Findings of fact which were supported by the evidence; 1a. Sweet Pea's received authorization to operate as a restauran (as defined in Ordinance No. 1 OOO-P, Code of Ordinances, Ci ty 0 La Porte) on April 6, 1983, at 2199 Underwood Road, La Porte Harris County, Texas. 1b. That the ordinance does not specify who is to verify th audit requested. - 2. On 11/17/86, the Chief BUilding Official of the City of L Porte, David A. Paulissen, recei ved a Sworn Complaint from L. Porte Police Department Officer R. Parker, a credible person alleging a violation of City of La Porte Ordinance No. 1000-p Section 1, Code of Ordinances, City of La Porte, (attached a: Prosecution Exhibit #1). 3. On November 17, 1986 from approximately 2:30 p.m. unti. approximately 4 :00 p.m. Officer R. Parker obssrvec1 approximatel' 15 customers purchase beer at Sweet Pea's. 4. No food was served to any customers at Sweet Pea's fro! approximately 2:30 p.m. until approximately 4:00 p.m. on Novembei 17, 1986. 5. The beer purchased on November 17, 1986 from approximatel~ 2 :30 p.m. until approximately 4 :00 p.m. by the approximately 1: customers, was not purchased as a beverage only in connection witi the service of prepared food to said customers.
