<br />e <br /> <br />e <br /> <br />r -- <br /> <br />share of the Southeast Plant, the Transmission System and the distribu- <br />tion system. In any event, no amendment to the Houston Contract shall <br />supersede or diminish the obligation of the City to adhere to the pro- <br />visions of this Contract or the City's obligation to pay for its share <br />of the debt service attributable to any Bonds issued pursuant hereto, <br />or otherwise to adhere to the Bond Resolution authorizing the sale of <br />such Bonds. <br />Section 2.08 The City recognizes that the Water to be <br />delivered by the Authori ty hereunder will be potable treated surface <br />water (i) that has been purchased by and delivered to the Authority by <br />Houston as the operator of the Southeast Plant; and (ii) that shall <br />meet all appl icable pur i ty standards a t the point of del i very to the <br />Participant of the Texas Department of Health and all other governmental <br />agencies with appropriate jurisdiction, as specified in Exhibit "A". <br />The City has satisfied itself that such water will be suitable for its <br />needs. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, \lliICH EXTEND <br />BEYOND THE DESCRIPTION ABOVE. <br />Section 2.09 The City may have the right to sell and deliver <br />Water to bulk purchasers thereof or other Participants who are not <br />customers of the City System, provided (a) all Water sold and delivered <br />to any such purchaser or Participant, for all purposes of this Contract, <br />shall be treated as a part of the Water delivered by the Authority to <br />the City hereunder, (b) the City shall not be relieved of its obligations <br />hereunder to pay for all such Water; (c) the Authority shall never be <br />required, without the written approval of all other Participants, to <br />deliver to the City any Water in excess of that resulting from the <br />City's share of the Demand Allocation or Pumping Allocation Factor in <br /> <br />-10- <br />
