<br />e <br /> <br />e <br /> <br />RESOLUTION NO. 87- <br /> <br />PRELIMINARY <br />DRAFT <br /> <br />A RESOLUTION ESTABLISHING THE POLICY OF THE CITY COUNCIL OF THE CITY OF LA <br />PORTE, ON THE ENFORCEMENT OF CITY OF LA PORTE ORDINANCE NO. 1559, "AN ORDINANCE <br />AMENDING CHAPTER FIVE, ANIMALS AND FOWL", OF THE CODE OF ORDINANCES OF THE CITY <br />OF LA PORTE; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte has heretofore, on the <br /> <br />14th day of September, 1987, passed and approved Ordinance No. 1559, an ordinance <br /> <br />amending Chapter Five, "Animals and Fowl", of the Code of Ordinances of the City <br /> <br />of La Porte. Certain questions have arisen as to the policies and procedures to <br /> <br />be followed in the enforcement of such ordinance. The purpose of this resolution <br /> <br />is to establish the policy of City Council on these matters. <br /> <br />Section 2. Section 5-38 of Ordinance No. 1559, provides that "No person <br /> <br />shall harbor, at any time, more than three dogs or cats over the age of six <br /> <br />months each, in any place in the City, except a duly licensed and permitted <br /> <br />breeding kennel, boarding kennel, veterinary hospital, or pet establishment." <br /> <br />It is the intention of City Council that persons residing in residentially zoned <br /> <br />areas of the City of La Porte'L~t~.can show proof in the form of City of La Porte <br />/U!tL/~~~~~~~ <br />registrationJof mo~1-th;R tRree dogs or cats, on the effective date of Ordinance <br /> <br />No. 1559, shall not be deemed to be in violation of Section 5-38 of the <br /> <br />Ordinance, solely because the number of dogs or cats owned by such person was <br /> <br />more than three on the effective date of the Ordinance, and may continue to <br /> <br />harbor such dogs or cats in excess of a total of three such animals, for the <br /> <br />remaining life of such dogs or cats in excess of three, owned by such person and <br /> <br />properly registered with the City of La Porte on the effective date of Ordinance <br /> <br />No. 1559. Such person shall not have the right to exceed the maximum number of <br /> <br />three dogs or cats, after the death or removal of the number of such animals in <br /> <br />excess of three. <br /> <br />Section 3. It is the intent of City Council that the provisions of Section <br /> <br />5-36, Barking Dogs, and the provisions of Section 5-38, Restricting the Number of <br /> <br />Dogs and Cats in Proximity to Residence of Another, shall be enforced on a <br /> <br />complaint basis only. It is further the intent of City Council that, in the <br /> <br />event of such complaint, that City Humane Officers shall attempt to mediate the <br /> <br />matter between the complainant and the owner of the animals in question, prior to <br /> <br />filing charges against the owner. <br /> <br />Section 4. This Resolution shall be effective upon its passage and <br /> <br />approval. <br />
