<br />e e <br /> <br />I N T E R L 0 C A LAG R E E MEN T <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HARRIS <br /> <br />THIS AGREEMENT, is made and entered into by and between the CITY <br />OF LA PORTE, TEXAS, a municipal corporation under the laws of the <br />State of Texas, hereinafter designated "City" and the HARRIS COUNTY <br />FLOOD CONTROL DISTRICT, a bOdy corporate and politic under the laws of <br />the State of Texas, hereinafter designated "District". <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, the City has appropriated funds from the sale of certain <br />general obligation bonds for improvements for the Unit F101-00-00 <br />watershed; and <br /> <br />WHEREAS, the City is otherwise obligated to expend said funds for <br />such improvements prior to October 31, 1988; and <br /> <br />,~ <br />~~ <br /> <br />WHEREAS, the District has completed and the City has approved the <br />Master Drainage Plan for Unit F101-00-00, hereinafter designated as <br />"Drainage Plan"; and <br /> <br />WHEREAS, the District and the City desire to cooperate in <br />improvements of Unit F101-00-00, in concurrence with Alternative I of <br />the Drainage Plan, hereinafter referred to as the "Project"; and <br /> <br />WHEREAS, the City agrees to reimburse the District $900,000 for <br />the City's share of the aforesaid Project; and <br /> <br />WHEREAS, the District and the City have determined it would be to <br />the mutual benefit of the City and the District to cooperate in the <br />Project and to share the costs of the project which accomplishes their <br />mutual desires, separate undertakings being more costly and less <br />efficient; and <br /> <br />WHEREAS, the District is willing to furnish all funds for the <br />Project not provided by the City and to diligently obtain all <br />right-of-way, let contracts for and administer the design and <br />construction of the Project, if and only if, the City will contribute <br />those funds referred to herein; and <br /> <br />WHEREAS, the City is willing to adjust all City owned utilities at <br />its own expense; <br />
