<br />e <br /> <br />e <br /> <br />make nis ballot in strict conformity with the cirections on the <br />ballot shall not invalidate the ballot~ and the ballot shall be <br />counted if the intention of the voter is clearly ascertainable, <br />except where the law expressly prOhibits the counting of the Ballot. <br />It is soecifically Cirecteb that the election officer shall not <br />refuse to count a ballot because of a voter having marked his ballot <br />by scratchin~ out tne proposition for wnich he does not wish to vote. <br />Section 9: That notice of the elections hereby ordered and <br />called shall be given: <br />a. ~y posting notice thereof at the offices of Bayshore <br />Municipal Utility District at 707 Shady River, La Porte, Texas, and <br />at the offices of the City of Shoreacres, 519 Shoreacres Blvd., <br />Shoreacres, Texas, at least thirty (30) days and not more than <br />forty-five (45) days before the election. Both locations for posting <br />are hereby declared to be public places within the District of the <br />City. <br /> <br />b. <br />Stat1.ltes, <br /> <br />By publication under Article 293, Vernon's Texas Civil <br />which notice shall state the nature and date of the election <br /> <br />the hours during which the polls will be open, and the location of <br />the polling place in the District where the notice is posted. Said <br />publication notice shall be pUblished in at least one newspaper of <br />general circulation in the County where the District and City are <br />located not more that thirty (30) days nor less than ten (10) days <br />before said election. The Board of Directors hereby finds that the <br />official newspaper of the District, Bayshore Sun, is a newspaper of <br />gQneral circulation in the County where the District and the City are <br />lo~ated. In order to comely with both Articvle 2ge, Vernon's Texas <br />Civil Statutes, and Article 4.05 of the Election Code, one of which <br />must be complied with, the said notice Shall be published between the <br />25th day prior to the election through the 11th day prior to the <br />elect iO)'"I. <br />Section 10: If any provision, section, subsection, sentence, <br />clause, or phase of this Resolution is for any reason held to be <br />unconstitutional Void or invalid or for any reason unenforceable, the <br />validity of the remaining portions of this Resolution shall not be <br />affected thereby, it being the intent of tne Board of Directors of <br />Bayshore Municipal Utility District in adopti~g this Resolution that <br />no portion hereof or provision contained herei~ shall become inoper- <br />ative or fail by reason of any unconstitutionality or invalidity of <br />any other portion, provision or regulation; and to this end all <br />provisions of the Resolution are declared to be severable. <br /> <br />READ AND APPROVED th~s 10~h Gay of Fecruary, 1988. <br />
