Herrera, City Ma~~~ <br /> <br />SUBJECT: BayMUD Annexation Policy Statement <br />Addendum to BayMUD Annexation Report Delivered 2/8/88 <br /> <br />Tonight the Council is asked to develop a policy statement on the <br />potential annexation of BayMUD. <br /> <br />Per your instruc t ion, I have v is i ted with BayMUD representat i v es <br />and expressed to them your wishes for an official written request <br />for annexation. Further, I pursued with BayMUD personnel our <br />concerns about the status of the oxidation ponds located at their <br />abandoned wastewater treatment facility located west of new State <br />Highway 146. <br /> <br />On February 11, 1988, a letter written to Mayor Malone was <br />delivered to my office from Mr. R. C. Morris, President of the <br />BayMUD Board of Superv isors. The letter requests La Porte to <br />annex the Bayshore Municipal Utility District upon receiving an <br />affirmative vote. The letter was later followed by a fully <br />executed resolution calling for an election to be held by BayMUD <br />on Saturday, May 7, 1988. <br /> <br />In exploring the status of the oxidation ponds with BayMUD <br />representatives, I was pleased to discover that they self <br />in it ia ted sample test ing of the ponds. One sample was submitted <br />to a laboratory and tested for presence of eight heavy materials. <br />The results reflect levels which are acceptable. BayMUD <br />understands that if the election is successful, staff will <br />coordinate with the district to develop guidelines for a thorough <br />analysis of the oxidation ponds, acceptable disposal methods, and <br />estimated costs for disDosa1. BayMUD is also aware that results <br />of this analysis may effect the City's decision on certain matters <br />relating to proposed annexation (i.e., timing, obligations before <br />and after annexation, etc.) <br />
