Agenda Date Requested: March <br />Requested By: Joel H, Albrec t artment:Community Development <br />Report esolution X Ordinance <br />Exhibits: 1) Dual Usage Agreement <br />2) Copy of Ordinance No. 1603 <br />3) Ordinance 1638 <br />SUMMARY & RECOMMENDATION <br />The attached Dual Usage Agreement between the City of La Porte and <br />Harris County Flood Control District is a step in the <br />implementation of The Open Space and Pedestrian System Plan set <br />forth in the City of La Porte Comprehensive Plan. The <br />Comprehensive Plan recommends a Pedestrian Circulation System that <br />will facilitate safe and easy access linking neighborhood and <br />community parks. <br />Ordinance No. 1603 granted a license to McDonald's for surface <br />usage of three hundred twenty-five (3251) feet of an alley in <br />Block 1101, Town of La Porte, Texas. Section 3 of Ordinance No. <br />1603 requires McDonald's Corporation to landscape and maintain a <br />conservation setback on the west four (41) feet of said alley and <br />the eastern most fifteen (151) feet of the Harris County Flood <br />Control right-of-way adjacent to the alley in accordance with the <br />requirements of Harris County Flood Control District. <br />The City's requirements in the Dual Usage Agreement are to be <br />transferred to McDonald's Corporation per Ordinance No. 1603 only <br />to the extent of its application to the three hundred twenty-five <br />(3251) feet by nineteen (191) feet described in Section 3. <br />Staff recommends the approval of the Dual Usage Agreement which <br />sets forth the requirements for plans and specifications, <br />construction, maintenance, alterations, public use and possible <br />widening to F216-00-00 further described as Little Cedar Bayou <br />Watershed. <br />Action Required by Council: <br />Approval of Ordinance agreeing to the Dual Usage Agreement with <br />Harris County Flood Control District. <br />Availability of Funds: <br />General Fund Water/Wastewater <br />Capital Improvement General Revenue Sharing <br />Other <br />Account Number: Funds Available: _ YES — NO <br />Approved for City Council Agenda <br />Gs�" T V�z�� -s— � <br />Robert T.
