ARMSTRONG <br />July 20, .1989 <br />The Honorable Mayor and <br />City Council <br />City of La Porte <br />City Hall <br />La Porte, Texas <br />Dear Lady and Gentlemen: <br />TELEPHONE 713 471 1686 <br />TELECOPIER 713 471 2047 <br />In connection with the resignation of Mike Shipp as Councilperson- <br />at-Large--Position B, I have prepared and enclose for the agenda <br />package, a form of ordinance calling a special election. <br />The Texas Secretary of State, in Election Law Opimion MAM-1, <br />requested by the City of La Porte in .1984, ruled that the City of La <br />Porte, which has three year terms of_ office for its councilpersons <br />and mayor, is not bound by the State Uniform Election Law on special <br />elections. Thus, the City Council need not wait. for the next <br />uniform election date, which would be in November. <br />Section 201.051, Texas Election Code, provides that a special <br />election to fill a vacancy in office shall be ordered as soon as <br />practical after the vacancy occurs. <br />The earliest practical election date is September 9, 1989. <br />Section 201.055, Texas Election Code, provides that the filing <br />deadline for a special election is shortened from 45 days before the <br />election, to 31 days before the election, if the election day is on <br />or after the 36th day after the date the election is ordered. Thus, <br />the filing deadline would be Wednesday, August 9, 1989, for a <br />September 9, 1989 election.
