Before the MRO verifies a confirmed positive result for <br />opiates, he or she shall determine that there is clinical <br />evidence - in addition to the urine test - of illegal use of <br />any opium, opiate or opium derivative (e.g., <br />morphine/codeine). However, this requirement will not apply <br />if the GC/MS confirmation testing for opiates confirms the <br />presence of 6-monoacetylmorphine. <br /> <br />5. Should any question arise as to the accuracy or validity <br />of a positive test result, the MRO will order a reanalysis <br />of the original specimen. <br /> <br />6. If the MRO determines there is a legitimate medical <br />explanation for the positive test result, the contract <br />vendor will report the test result to the City as negative. <br /> <br />7. Prior to making a final decision to verify a positive <br />test result, the MRO will offer the individual an <br />opportunity to discuss the test result either telephonically <br />or in person. Following verification of a positive test <br />result by the MRO, the contract vendor will report the <br />result to the City. <br /> <br />8. Any individual who has tested positive will have <br />available as an affirmative defense, to be proven by the <br />individual through clear and convincing evidence, that <br />his/her use of alcohol or a drug (except for methadone) was <br />prescribed by a licensed medical practitioner who is <br />familiar with the individual's medical history and assigned <br />duties. <br /> <br />9. If the individual is desirous of a second opinion, he or <br />she may request a retest by an alternate laboratory, <br />acceptable to the City, of the same specimen at the <br />individual's expense. <br /> <br />XI. Employee Assistance Program (EAP) <br /> <br />A. Education and Training <br /> <br />1. The City will: <br /> <br />- Provide education for employees which addresses the <br />safety and health risks assQciated with drug and alcohol <br />use; <br /> <br />- Provide training for managers and supervisors which <br />addresses the City's intervention tactics for controlling <br />drug and alcohol use in the workplace; <br /> <br />- Document the education and training given to <br />employees, managers and supervisors. <br />
