Search of an individual and his or her personal property <br />may be made when there is reasonable cause to believe that <br />the individual is in violation of the City's Drug and <br />Alcohol Abuse Policy. <br /> <br />D. An individual's consent to a search is required as a <br />condition of employment and the individual's refusal to <br />consent may result in disciplinary action, including <br />discharge or disbarment from the workplace, even for a first <br />refusal. <br /> <br />E. Illegal drugs, drugs believed to be illegal, and drug <br />paraphernalia found on City property will be turned over to <br />the appropriate law enforcement agency and full cooperation <br />given to any subsequent investigation. Substances which <br />cannot be identified as an illegal drug by a layman's <br />examination will be turned over to a drug testing vendor for <br />scientific analysis. <br /> <br />F. Other forms of contraband, such as firearms, explosives, <br />and lethal weapons, will be subject to seizure during an <br />inspection or search. An individual who is found to possess <br />contraband on City property or while on City business will <br />be subject to discipline up to and including discharge or <br />disbarment from the workplace. <br /> <br />G. Searches will be conducted as follows: <br /> <br />1. A search team will be designated in advance. A team <br />will consist of two or three persons who may be a senior <br />person at the facility or location where the search is to be <br />conducted, a representative of the security or human <br />relations department, or a contract searcher. <br /> <br />2. A contract searcher is a professional security person <br />hired to conduct the search. The contract searcher mayor <br />may not utilize trained search dogs. When a contract <br />searcher is used, the other team members will participate as <br />observers and intervene as necessary to deal with problems. <br /> <br />3. In advance of the search, the team will develop a plan <br />that takes into account such details as when and where to <br />start, how to announce the search, how to close off the <br />area(s) where the search will be conducted, what work <br />operations will be suspended, and how to handle confiscated <br />materials. <br /> <br />4. On the day of the search and when the team is ready to <br />begin, a senior person at the facility will assemble the <br />affected persons into a convenient area where they will be <br />told that a search is to be conducted. The affected persons <br />will receive instructions that highlight the City's policy <br />regarding searches. An individual's right to withhold <br />consent to a search, and the City's right to immediately <br />
