<br />-2- <br />IV. <br />Attorney hereby agrees to file suit on and reduce to judgment <br />and sale all property located within City's taxing jurisdiction with <br />City to furnish the necessary data and information as to name, <br />identity, location of all necessary parties, and legal description <br />of the property to be sold, as reflected by the tax records of City. <br />When a title search is required, Attorney hereby agrees to supervise <br />said title search, with costs to be reimbursed out of court costs. <br />Attorney hereby agrees to sue for recovery of the costs as court <br />costs as provided by Section 33.48 of the Texas Property Tax Code. <br />V. <br />Attorney hereby agrees to provide to City, at his sole cost and <br />expense, a tax collection data processing system that shall include <br />software and hardware, with specifications to be mutually agreed <br />upon between the parties, for the term of this contract. The data <br />processing system shall be installed on City premises to be <br />designated by City. Legal title to the data processing system shall <br />remain in Attorney. Attorney shall be responsible for all upkeep, <br />maintenance, insurance, and taxes on the system, both software and <br />hardware. City shall have the right to install at its expense, <br />hardware and software enhancements to the system, for use by the <br />City for purposes other than tax collection data processing. City <br />shall be responsible for all costs associated with such upgrades. <br />City shall have the right to purchase said data processing system <br />from Attorney, at any time after two years from the effective date <br />of this contract, with the price to be based on the fair market <br />value of the system at the time of purchase, as determined by <br />recognized computer industry appraisal publications at the time of <br />purchase. <br />VI. <br />Attorney hereby agrees to make progress reports to City on <br />request, and to advise the City of all cases when investigation <br />reveals delinquent taxpayers to be financially unable to pay their <br />delinquent taxes. <br />
