i • <br />RESOLUTION NO. 91- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTS, TEXAS, <br />APPROVING PARTICIPATION IN THE TELEPHONE FRANCHISE STEERING <br />COMMITTEE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br />WHEREAS, the City has a public responsibility to protect the <br />public rights-of-way and easements and to require the telephone <br />company to assume certain duties and responsibilities regarding such <br />easements and rights-of-way by means of reasonable terms and <br />conditions in a franchise ordinance; and <br />WHEREAS, a steering committee of cities could share <br />information, develop a model ordinance, obtain special legal and <br />auditing counsel and provide further assistance to the member cities <br />in the adoption of franchise ordinances with the telephone utility <br />company; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTS: <br />Section 1. That the participation by the City in the Telephone <br />Franchise Steering Committee is hereby approved and does not <br />obligate the City to any payment. <br />Section 2. It is anticipated that a pro-rata fee shall be <br />assessed by the Telephone Franchise Steering Committee at a later <br />date. Such financial obligation shall require the approval of a <br />separate resolution. Such fee shall be based upon expected costs <br />for the purposes stated above and be determined by the population of <br />the City. <br />Section 3. The City Council officially finds, determines, <br />recites and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />City of La Porte, Texas for the time required by law preceding this <br />meeting, as required by the Open Meetings Law, Article 6252-17, <br />Texas Revised Civil Statutes Annotated; and that this meeting has <br />been open to the public as required by law at all times during which <br />this resolution and the subject matter thereof has been discussed, <br />considered and formally acted upon. The City Council further <br />ratifies, approves and confirms such written notice and the contents <br />and posting thereof. <br />Section 4. This Resolution shall be in effect from and after <br />its passage and approval. <br />
