• <br />ORDINANCE N0. <br />AN ORDINANCE ADOPTING THE PROVISIONS OF ARTICLE 8309h, SECTION 5(c), <br />WORRMEN'S COMPENSATION INSURANCE FOR EMPLOYEES OF POLITICAL <br />SUBDIVISIONS, TEXAS REVISED CIVIL STATUTES; FINDING COMPLIANCE WITH <br />THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. The City Council of the City of La Porte hereby <br />adopts the provisions of Article 8309h, Section 5(c), Workmen's <br />Compensation Insurance for Employees of Political Subdivisions, <br />Texas Revised Civil Statutes, which reads as follows, to-wit: <br />"(c) By a majority vote, the governing body of a political <br />subdivision may provide that during the time an employee of a <br />political subdivision is receiving weekly compensation benefits <br />under this article that employee may elect to receive <br />previously accrued sick leave benefits, whether statutory or <br />contractual, in an amount equal to the difference in the weekly <br />payments of compensation under this article and the weekly <br />compensation that that employee was receiving prior to the <br />injury or illness resulting in the claim, with a proportionate <br />deduction in the employee's sick leave balance. The sum of <br />weekly payments of compensation under this article and the <br />amount of sick leave paid by the political subdivision may not <br />exceed the amount of weekly compensation that the employee was <br />receiving prior to the illness or injury that resulted in the <br />claim. This section may not be construed to limit in any way <br />the medical benefits to be paid to the employee, and no such <br />sick leave plan may require an employee to take sick leave <br />benefits before receiving benefits under the Texas Workers' <br />Compensation Act (S.B. No. 1, Acts of the 71st Legislature, 2nd <br />Called Session, 1989)." <br />Section 2. The City Council officially finds, determines, <br />recites and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />City for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Article 6252-17, Texas Revised <br />Civil Statutes Annotated; and that this meeting has been open to the <br />public as required by law at all times during which this ordinance <br />and the subject matter thereof has been discussed, considered and <br />formally acted upon. The City Council further ratifies, approves <br />and confirms such written notice and the contents and posting <br />thereof. <br />Section 3. This Ordinance shall be effective from and after <br />its passage and approval, and it is so ordered. <br />
