• <br /> <br />CITY OF LA PORTE <br />INTER-OFFICE MEMORANDUM <br />JANUARY 9, 1992 <br />TO: John Joerns, Assistant City Manager <br />FROM: Phil Hoza, Engineering Tech -' <br />SUBJECT: Status of the Proposed 12" Diameter Water Line Along Spencer Highway <br />CLP Project No. 89-6105 <br />Final design is approximately 95% complete on the above referenced project, items <br />remaining will be revisions based on staff reviews and comments from other agencies. <br />Because of the limited (8.5 feet) space to remain within the existing right of way between <br />the back of the proposed curb and property line and a preliminary cost estimate which <br />indicated a possible savings of $87,000.00, the City instructed the Engineer to route the <br />line in a proposed 10 foot easement immediately south and parallel to Spencer Highway. <br />This would allow for a more effective means of providing maintenance and repair to the <br />line as well as eliminate conflicts with existing utilities due to overcrowding within the right <br />of way. <br />The proposed 10 foot easement necessitated easement acquisition from thirty (30) <br />individual property owners. With the assistance from the City Attorney's office and the <br />office of Jim Burgin & Associates, Inc., we've acquired all of the easements with the <br />exception of the following: <br />1) Ms. Hazel Flannery <br />2) Earnest Weatherford <br />3) Brenda Kay Christoph <br />Their refusal to execute such an easement with the City has prompted staff to recommend <br />condemnation action to prevent any further delay on the project. In addition, staff is <br />continuing to work out agreements with Harris County Flood Control and the Houston <br />Lighting and Power Company in order to cross their facilities. These agreements should <br />be completed well in advance of construction. <br />The City initially budgeted $38,500.00 to cover expenses associated with these easement <br />acquisitions. To date, $16,488.00 has been spent. <br />If you have any questions, please feel free to call. <br />
