<br />e <br /> <br />e <br /> <br />RECEIVED <br /> <br />EXPLANATION OF FEES <br />REGIONAL WATER QUALITY ASSESSMENT PROG <br /> <br />MAR 2 1992 <br />Ci I" MANAGERS <br />OFFICE <br /> <br />Senate Bill 818, which was passed by the Texas Legislature in the <br />1991 regular session and went into effect in June, 1991, requires <br />a comprehensive water quality assessment in each river basin. In <br />most cases, the assessment will be done by a river authority, or <br />other designated local government, under supervision of the Texas <br />Water Commission. <br /> <br />The bill requires the Commission to recover the reasonable costs of <br />administering the assessment program from wastewater permit holders <br />and water right permit holders. Commission rules (TAC, Sections <br />320.21-320.22) were adopted to provide an equitable funding <br />procedure, and the resulting fee calculation method is as follows: <br /> <br />Wastewater Permits The fee is assessed on the basis of final <br />flow and traditional pollutant limits. Flow calculations are <br />based on the daily average flow limit in the permit; where the <br />permit does not specify a daily average flow limit, the charge <br />is based on 50% of the daily maximum flow limit. The fee per <br />facility is the sum of the following: <br /> <br />contaminated flow $300 per MGD, for 100 MGD or less <br />$10 per MGD, over 100 MGD <br /> <br />Uncontaminated flow $1 per MGD <br /> <br />Traditional pollutants $2 per lb per day <br /> <br />For permits which authorize a discharge, and/or with flow or <br />pollutant limits, the fee will not be less than $200 nor more <br />than $35,000. <br /> <br />For permits without an authorized discharge, and without flow <br />or pollutant limits, the fee is $150. For inactive permits, <br />the fee is $100. <br /> <br />Water Riqht Permits Charges for water rights are not included <br />here, but will be billed separately within the next few weeks. <br />Water right permit holders who have a water right for <br />municipal or industrial use and who also have a wastewater <br />permit will not be assessed a fee for the municipal or <br />industrial portion of that wat~r right, but will be assessed <br />a fee for the associated wastewater permit and a fee for any <br />water right uses other than municipal or industrial. <br /> <br />A copy of your permit may be purchased by contacting the TWC's <br />Records Services at 512/463-8562. <br /> <br />( over) <br />
