<br />e <br /> <br />e <br /> <br />And finally, the current ordinance requires that a plot plan, drawn by a <br />licensed Texas public surveyor, be included with the application. For many of <br />the properties requested to be closed, there exist a recorded plat that <br />contains all the information that the plot would provide. It would be <br />beneficial to allow someone from the city, preferably the City Engineer, to <br />waive the requirement of the plot plan if sufficient information is contained <br />on the recorded plat. <br /> <br />Recommendation <br /> <br />The City should change the method of obtain values of public rights-of-ways <br />that are sold to an adjoining property owner. Ordinance 1550 should be <br />changed to reflect that the City of La Porte will utilize the published tax <br />value on the most recent tax roll to determine the square foot value and apply <br />a factor or markup of 175% to this value to obtain the sales price. The <br />change to the ordinance that would accomplish this would occur in the <br />paragraph that begins "Upon agreement" and would be to delete the words "Prime <br />Rate" and to change the factor to 1.75. <br /> <br />In addition, the ordinance should be amended to state that, unless otherwise <br />directed by City Council, all proceeds from the sale of these types of <br />properties should be deposited into the General Capital Improvement Fund for <br />future reinvestment in the City. This would help prevent the dilution of City <br />assets while still providing Council the means of diverting these funds as <br />they see fit. <br /> <br />Finally, the ordinance should be amended to provide the City Engineer, or his <br />designee, the latitude to waive the requirement for the plot plan when the <br />recorded plat contain the information that would be gathered by the plot plan. <br />
