<br />e <br /> <br /> <br />e <br /> <br />CITY, at the direction of the City Manager shall have the power to <br /> <br />remove or abate the same at the expense of the TELEPHONE COMPANY, <br /> <br />all without compensation or liability for damages to the TELEPHONE <br /> <br />COMPANY. <br /> <br />TELEPHON,E COMPANY shall promptly restore to as good <br /> <br />condition as before and to the reasonable satisfaction of the City <br /> <br />Engineer, all RIGHTS-OF-WAY damaged or excavated by the TELEPHONE <br />COMPANY. Should the CITY reasonably determine, wi thin one year from <br /> <br />the date of such restoration, that such surface requires additional <br /> <br />restoration work to place it in as good a condition as before the <br /> <br />commencement of the work, the TELEPHONE COMPANY shall perform such <br /> <br />additional restoration work to the reasonable satisfaction of the <br /> <br />. <br />CITY. Engineering plans for projects involving significant amounts <br />of new buried cable and underground conduit systems to be placed in <br /> <br />RIGHTS-OF-WAY shall be submitted to the City Engineer for review and <br /> <br />approval prior to construction. <br /> <br />(b) Except in an emergency, the TELEPHONE COMPANY shall not <br /> <br />excavate any RIGHT-OF-WAY without first notifying the City Engineer, <br /> <br />and, if approval is required it shall be given if the proposed <br /> <br />excavation is in compliance with the requirements of CITY <br /> <br />governance. The City Engineer or his designee shall be notified as <br /> <br />soon as practicable regarding work performed under emergency <br /> <br />conditions, and the TELEPHONE COMPANY shall comply with any <br /> <br />-13- <br />
