<br />e <br /> <br /> <br />e <br /> <br />COMPANY'S FACILITIES. <br /> <br />SECTION 9 - TREE TRIMMING <br /> <br />The right, license, privilege and permission is hereby granted to <br />the TELEPHONE COMPANY, its contractors and agents, to trim trees <br />upon and overhanging the streets, avenues, highways, alleys, <br />sidewalks and public places of the CITY so as to prevent the <br />branches of such trees from coming in contact with the aerial wires, <br />fiber or cables of the TELEPHONE COMPANY. <br /> <br />SECTION 10 - INDEMNITY <br /> <br />The ~ELEPHONE COMPANY shall indemnify and hold the CITY harmless <br />from all costs, expenses (including attorney's fees) and damages to <br />persons or property arising directly or indirectly out of the <br />construction, maintenance or operation of the TELEPHONE COMPANY'S <br />FACILITIES located within the public RIGHTS-OF-WAY found to be <br />caused solely by the negligence of the TELEPHONE COMPANY or its <br />agents and employees. This provision is not intended to create a <br />cause of action or liability for the benefit of third parties but is <br /> <br />-18- <br />
