RESOLUTION NO. 94-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE REQUESTING <br />HAMS COUNTY COMMISSIONERS COURT TO COLLECT AN ADDITIONAL FEE ON <br />EVERY ADMISSION TO THE SAN HOUSTON RACE TRACK; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />WHEREAS, the Texas Racing Act states that "if [a] racetrack is <br />not located within an. incorporated town, the [county commissioners] <br />court may collect an additional [admission] fee not to exceed <br />fifteen cents ($0.15) if requested to do so by the governing bodies <br />of a majority of the incorporated cities and towns in the county." <br />Tex. Rev. Civ. Stat. Ann. art.- 179e S6.17 (Vernon 1993); and <br />WHEREAS, such additional fee will be allocated based upon the <br />population within the county of the cities or towns; and <br />WHEREAS,,. the Sam Houston Race Track is a licensed racetrack <br />that is located in Harris County, Texas and lies outside the <br />incorporated limits of any city or town; and <br />WHEREAS, the City of La Porte is located, in Harris County, <br />Texas, and <br />WHEREAS, the City Council of the City of La Porte desires to <br />request the Harris County Commissioners Court to collect the <br />additional fee as allowed by law on its behalf. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE, TEXAS; <br />Section 1: That the City Council of City'of La Porte hereby <br />requests the Commissioners - Court of Harris County, Texas, to <br />collect an additional fee, not to exceed fifteen cents ($0.15) , for <br />admission into the Sam Houston Race Track pursuant to the Section <br />6.17 of Texas Racing Act. Tex. Rev. Civ. Stat.
