<br /> <br />e <br /> <br />City of La Porte <br />Established 1892 <br /> <br />October 11, 1994 <br /> <br />Honorable Mayor Norman Malone and City Council <br />City of La Porte <br /> <br />Re: Special Conditional Use Permit Request #SCU94-001 <br /> <br />Dear Mayor Malone: <br /> <br />The La Porte Planning and Zoning Commission, during its September 15, 1994, and <br />September 29, 1994, public hearings and regular meetings, considered Special Conditional <br />Use Permit Request #SCU94-001. The permit has been requested for an 87 acre tract <br />comprised of portions of Tract #2 of the Enoch Brinson Survey and Lots 13; 14; 19; 20; 29; <br />30 of the Nebraska Syndicate. The purpose of the permit is to allow the property in <br />question to be fenced and used to pasture livestock. <br /> <br />One of the conditions that staff recommended for this permit is the requirement that <br />dedicated rights-of-way extending onto the property be left unfenced and unobstructed. This <br />would require fencing the property into multiple, smaller pastures. The applicant, during <br />his public hearing testimony, indicated that the smaller pastures would not provide a <br />workable arrangement for his needs. <br /> <br />The Planning and Zoning Commission concurs with staff regarding the need for public <br />rights-of-way to remain open and unobstructed. The Commission also recognizes that it is <br />the responsibility of the property owner to petition City Council regarding closure or private <br />use of rights-of-way. Staffs report, detailing the facts relating to this and other issues <br />considered by the Commissio!l, is attached and follows this report. <br /> <br />Based on these circumstances and considerations, the Planning and Zoning Commission has, <br />by a six to one vote, recommended that Special Conditional Use Permit Request #SCU94- <br />001 be denied.
