<br />e <br /> <br />EXHIBIT "A" <br /> <br />e <br /> <br />· Fencing adjacent to Barbour's Cut Blvd., North 13th Street and North "H" Street <br />(Fair Lane) shall be setback at least 25 feet from property lines. <br /> <br />· Fencing adjacent to Highway 146 shall be erected along the proposed right-of-way <br />lines established by the State Highway Department. <br /> <br />· There shall be no access from the developed portions of the "H" Street and 13th <br />Street rights-of-way. Additionally, gates shall be located at least 100 feet away from <br />residential homesites. Final locations shall be subject to approval by the Director of <br />Planning. <br /> <br />· Driveways, conforming to City requirements shall be installed between gates and <br />adjacent developed roads. <br /> <br />· Water troughs shall be located as near as possible to western property boundaries. <br />Final locations shall be subject to approval by the Director of Planning. <br /> <br />· Applicant shall secure written permission from Southern Pacific allowing water <br />service lines to cross any property not covered by the applicant's lease. Permission <br />must remain in effect for duration of the applicant's lease. A copy of the permission <br />letter shall be submitted to the City for attachment to the applicant's Conditional <br />Use Permit. <br /> <br />· The 25 foot buffer areas adjacent to Barbour's Cut, 13th Street, "H" Street, and the <br />adjacent undeveloped right-of-way shall be maintained by the applicant. They shall <br />be mowed a minimum of once each 30 days. <br /> <br />· Dedicated rights-of-way shall remain unfenced and unobstructed. <br /> <br />· Property designated for use in the F-101 drainage project shall remain unfenced and <br />unobstructed. <br /> <br />· Applicants shall, prior to erection of fencing, submit to the Director of Planning, a <br />letter from Houston Lighting and Power Company stating that arrangements for <br />access to the property are adequate and satisfactory. As an alternative, the "H" <br />Street right-of-way can remain unfenced and unobstructed. <br /> <br />· Animal concentration shall not exceed one (1) animal per each 1.75 acres of pasture <br />area. This concentration limit shall apply to each separately fenced pasture. <br /> <br />· This permit shall be valid for a period of one (1) year from date of Council approval. <br />At the end of this period, the applicant shall apply for a new Special Conditional Use <br />Permit. <br /> <br />· At such time as the applicant's lease with Southern Pacific is allowed to lapse, or is <br />terminated by either party, this Special Conditional Use Permit will become void and <br />all livestock must be removed from this tract. <br />
