Gillett ~~ Department: <br />Report Resolution <br /> <br />Public Works <br /> <br />xxxx <br /> <br />Ordinance <br /> <br />Exhibits: Ordinance 95- <br />Commercial Solid Waste Contract <br /> <br />SUMMARY & RECOMMENDATION <br /> <br />On October 22, 1990, the City Council approved a five (5) year contract <br />with Browning-Ferris, Inc. (BFI) to provide commercial solid waste <br />collection and disposal services within the city of La Porte. The Contract <br />included a renewal clause for an additional five (5) year term upon the <br />mutual agreement of the parties. The city has negotiated a new five (5) <br />year contract with BFI to provide commercial solid waste collection and <br />disposal, with a five (5) year renewal option. The new rate represents a <br />3% increase over the current rate. The Contract allows for an annual cost <br />of living adjustment based on the Consumer Price Index for all Urban <br />Consumers (CPI-U), with a maximum rate increase of 4% for anyone year. <br /> <br />The new contract contains a few differences. The rate for roll-off <br />containers is broken into three parts: 1) collection and transport (base <br />rate), 2) disposal and 3) state tax. The annual adjustment of the base <br />rate will be based on CPI-U. The disposal rate will be adjusted to reflect <br />actual cost, however, please note that the maximum disposal rate cannot <br />exceed the City's contractual rate with Sanifill, which is also based on <br />CPI-U. Also added to the Contract is a rate for Special collection of <br />heavy trash. This rate, set up much like the roll-off rate, is designed to <br />be used for special trash collections within the City, such as contractor- <br />generated debris. It will also provide a safety valve for collection of <br />trash that cannot be collected by City forces. <br /> <br />Finally, the Contract provides that the Contractor will collect and dispose <br />of all waste generated by City operations, as well as periodic festivals <br />and events, such as Sylvan Beach Day.
