Policy for Providing Water to Industries Outside the City Limits (but within ETJ) <br />SUMMARY & RECOMMENDATION <br />On May 8, 1995, Council approved a policy for provision of potable water service to <br />companies outside the corporate city limits that have current Industrial District <br />Agreements with the City. In addition, the proposed Water Service, and Utility <br />Extension Agreements that were presented, received approval as to form. <br />Rohm and Haas Company, Bayport Plant wishes to pursue water service under the <br />terms and conditions offered by the City. Based on 135 employees, the average <br />monthly demand will be 205,875 gallons, for which Rohm and Haas will pay one and <br />one-half (1 %i) times the City's current rate. <br />The term of the Water Service Agreement is for five (5) years, plus any renewals and <br />extensions thereof. However, the Agreement shall automatically expire at such time <br />as there is no effective Industrial Agreement between the parties or if the City <br />exercise the right of termination. Based on 135 employees, Rohm and Haas shall be <br />subject to an administrative connection charge in the amount of $13,500. A copy of <br />the Agreements are included for Council's review. <br />Staff recommends approval of the Water Service, and Utility Extension Agreements <br />submitted. <br />Action Required by Council: <br />Consider approval of an ordinance authorizing the City to enter into a Water Service <br />Agreement and a Utility Extension Agreement with Rohm and Haas Company, Bayport <br />Plant. <br />Availability of Funds: N/A <br />General Fund Water/Wastewater <br />Capital Improvement General Revenue Sharing <br />Other <br />Account Number: Funds Available: YES NO <br />Approved for City Council Agenda <br />Robert T.
