Exhibit A - Changes to Ordinance 94-1976 Ordinance No. 96-1976A SUMMARY & RECOMMENDATION There have been problems in the past regarding the rental policies established by Ordinance No. 94-1976 which governs the rental of the Rodeo Arena. In particular, the strict interpretation of the Ordinance requires that a ReservationlDamage Deposit be required for each event reserved at the Arena. If an individual or group wanted to have a series of six, eight, or ten events at the arena, they would be required to put up a One Hundred Dollars deposit per event or, in the cases as outlined above; Six Hundred to One Thousand Dollars in reservation fees. This places an undue burden on some groups who must deposit large sums to reserve the facility when scheduling events in series. Staff met with representatives of the La Porte Livestock Show and Rodeo Association and established wording that should be changed in the existing ordinance. Attached as Exhibit A is a reprint of the existing ordinance and well as additions. Additions to the ordinance are indicated by shading; removals by strikeout. The proposed Ordinance amendment provides for a maximum of One Hundred Dollars for multiple rental reservations at the Arena. However, if the group or individual cancels two reservations in any calendar year, they would then be required to post the One Hundred Dollar Deposit for each scheduled event for the remainder of the calendar year. This would prevent an individual or group from scheduling events, then canceling at the last minute; thereby depriving the City the right to rent to someone else. The proposed Ordinance amendment also clarifies the procedure for Arena reservations by telephone. Staff recommends approval of the Ordinance amending Ordinance No. 94-1976 which governs the rental fee policy and schedule for the La Porte Livestock/Rodeo Arena.
