<br />. <br /> <br />. <br /> <br />StafTReport Bayou Forest Apartments June 19, 1997 <br />Special Conditional Use Permit #SCUP 97-001 <br /> <br />. Reauested B1:: Mr. Edward Cooke and Mr. Edward Dutke, on behalf of <br />Forest Holdings L.L.P., and Mr. Jim Clifton of Sterling <br />Development <br /> <br />Reauested For: A 10.54 acre tract out of the W. P. Harris Survey, Abst. A- <br />30, Harris County, La Porte, Texas. This property is <br />further described as being located in the 1200 Block ofMc <br />Cabe Road. The project is identified as the Bayou Forest <br />Apartments. (See Exhibit A) <br /> <br />Present Zonine: Planned Unit Development (p.nD.) and Neighborhood <br />Commercial (NC) <br /> <br />Puroose of Reauest: <br /> <br />Applicants are seeking a Special Conditional Use Permit <br />(SCUP) for the purpose of developing an apartment <br />complex within a Planned Unit Development (p.nD.) <br />zone. This SCUP is required by Section 8-400 of the City <br />Zoning Ordinance 1501. <br /> <br />Backeround: <br /> <br />The purpose of this hearing is to consider Special <br />Conditional Use Permit Request #SCU97-001. This <br />request is being processed simultaneously with the Bayou <br />Forest Apartments General Plan as required by the City's <br />zoning ordinance. <br /> <br />Analvsis: <br /> <br />Zoning Ordinance Section 10-200 establishes the following <br />review criteria and conditions for approval of Special <br />Conditional Use Permits: <br /> <br />. That the specific use will be compatible with and not <br />injurious to the use and enjoyment of other property, <br />nor significantly diminish or impair property values <br />within the immediate vicinity. <br /> <br />· That the conditions placed on such use, as specified in <br />each district, have been met by the applicant. <br /> <br />. That the applicant has agreed to meet any additional <br />conditions imposed, based on specific site constraints <br />necessary to protect the public interest and welfare of <br />the community. <br />
