<br />e <br /> <br />e <br /> <br />D. Conduct <br /> <br />1. Assi gnabi lity <br /> <br />The Subrecipient shall not assign or transfer any interest in this Agreement <br />without the prior written consent of the Grantee thereto; provided, however, that <br />claims for money due or to become due to the Subrecipient from the Grantee <br />under this Agreement may be assigned to a bank, trust company, or other financial <br />institution without such approval. Notice of any such assignment or transfer shall <br />be furnished promptly to the Grantee. <br /> <br />2. Hatch Act <br /> <br />The Subrecipient agrees that no funds provided, nor personnel employed under <br />this Agreement, shall be in any way or to any extent engaged in the conduct of <br />political activities in violation of Chapter 15 of Title V Vnited States Code. <br /> <br />3. Conflict of Interest <br /> <br />The Subrecipient agrees to abide by the provisions of 24 CFR 570.611 with <br />respect to conflicts of interest, and covenants that it presently has no financial <br />interest and shall not acquire any financial interest, direct or indirect, which would <br />conflict in any manner or degree with the performance of services required under <br />this Agreement. The Sub recipient further covenants that in the performance of <br />this Agreement no person having such a financial interest shall be employed or <br />retained by the Subrecipient hereunder. These conflict of interest provisions <br />apply to any person who is an employee, agent, consultant, officer, or elected <br />official or appointed official of the Grantee, or of any designated public agencies <br />or subrecipients which are receiving funds under the CDBG Entitlement program. <br /> <br />The Subrecipient also agrees to abide by 18 V.S.C. 286, which provides for <br />conspiracy to defraud the Federal Government with Respect to Claims. In <br />addition, the Subrecipient will also abide by the False Claims Act (31 U.S.C. <br />3729 et seq.), 18 U.S.C. 287 relating to False, Fictitious and Fraudulent Claims, <br />18 U.S.C. 245 Federally Protected Activities, 18 U.S.C. 1001 regarding General <br />Statements or Entries, the Program Fraud Civil Remedies Act (31 V.S.C. 3801- <br />3812), the Federal Claims Collection Act of 1966 (31 V.S.C. 952) as amended by <br />the Derby Collection Act of 1982, the Meritorious Claims Act (31 V.S.C. 3702), <br />the Tucker Act (28 V.S.C. 1346, 1491, and 2501), the Wunderlich Act (41 V.S.C. <br />321-322)" the Anti-Deficiency Act (31 V.S.C. 1341), and Section 208(a) of the <br />Intergovernmental Personnel Act of 1970, as amended, insofar as they apply to <br />the terms of this Agreement. <br /> <br />18 <br />
