<br />UKAr I <br /> <br />Article 4 above. W_ thirty (30) ~ consecutive calendar. after the City's authorization <br />for City's contractor to begin construction of trunk sewer main and lift station facilities. <br />Developer shall deposit with City in escrow a sum equal to fifty percent (50%) of the <br />$119,500.00 as described in Article (4) above. <br /> <br />6. City agrees that connection charges for sanitary sewer shall be considered paid for full <br />development of a 1O.35-acre site shown on Exhibit "A", when the above payment has been <br />made to City. Developer shall pay to City connection charges for water service for 10.35-acres <br />in the amount of $32,911.76. Payment of connection charges for water service shall be made <br />when building permits are issued by the City for Developer's multi-family project. Developer <br />shall be responsible for all other customary charges. <br /> <br />7. If City does not construct and install utility mains according to plans and specifications prepared <br />by the City's engineer within sixty (60) months from the date the building permit is issued, City <br />will refund the Developer the difference between the amount Developer has paid City for <br />Wastewater facilities under this agreement and nine percent (9%) of the cost of the City's <br />engineer in preparing plans and specifications for the construction of utility mains. <br /> <br />INTERIM SERVICE <br /> <br />1. By separate agreement the Developer shall arrange for interim sewer service from the City of <br />Shoreacres. Developer agrees to acknowledge that all issues and costs related to "Interim <br />Service" are the responsibility of Developer. Developer agrees to pay for the construction and <br />installation of a. sewer main(s) and lift station facilities to connect the sewage outflow from the <br />Property of the City of Shoreacres mainline into the manhole on the north end of Bayou Forest <br />Drive for transporting such sewage to the Gulf Coast Waste Disposal Facility. Such <br />construction and installation shall include all necessary appurtenances. Developer further agrees <br />to pay all engineering fees for survey, design, contract documents, bidding, construction <br />staking, construction inspection, and preparation of "Record" drawings. <br /> <br />2. Developer shall furnish to City for review and approval an executed Agreement with <br />Shoreacres prior to submission of the construction plans and specifications for interim service. <br /> <br />C:/My Documents/Water and Sewerlbayou forestUEA_980512 <br />10 <br />
