e e AGREEMENT CLP Project No. 98-4503 THIS AGREEMENT, made this 27th day of July ,1998, by and between the CITY OF LA PORTE, hereinafter called "Owner", acting herein through its CITY MANAGER and Brooks Concrete. Inc. (Name of Contracting Firm) Strike out inapplicable terms: (a corporation) (a partnership) or (an individual doing business as:) of Pasadena , County of Harris and State of Texas, hereinafter called "Contractor". WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned, to be made and performed by the OWNER, the CONTRACTOR hereby agrees with the OWNER to commence and complete the construction described as follows: CITY WIDE SIDEWALK REPLACEMENT PROJECT FY 97-98 & FAIRMONT PARKWAY PEDESTRIAN PLAN PHASE II CLP PROJECT NO. 98-4503 hereinafter called the project, for the Total Price of sixty-eight thousand four hundred twenty-four and no/oo Dollars ($ 68.424.00) and all extra work in connedion therewith, under the terms as stated in the General and Supplementary Conditions of the Contract; and Further, that the CONTRACTOR agrees, at his (its or their) own proper cost and expense, to furnish all the materials, supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories and services necessary to complete the said project in accordance with: A. The terms and conditions stated in the Proposal and in the General Conditions, and Supplementary Conditions of this Contract; Scope of Work B. The plans, which include all maps, plats, blue prints, and other drawings and printed or written explanatory matter thereof; and C. The Specifications and other contract documents therefore, as prepared by the City of La Porte, all of which are made a part hereof and colledive(y evidence and constitute the contract.
