<br />REO'ST FOR CITY COUNCIL AGIDA ITEM <br /> <br />Agenda Date Requested: October 26~ <br />Requested By: Doug Kneuppe~ Department: <br />Report e ution <br /> <br />Planning <br />X Ordinance <br /> <br />Exhibits: <br /> <br />1. <br /> <br />Ordinance <br /> <br />Summary & Recommendation <br /> <br />In recent months, the Planning and Zoning Commission has reviewed numerous minor <br />subdivision plats that usually contain one or two lots and front on an existing roadway with <br />utilities already available. <br /> <br />State law allows for the delegation of approval responsibility to a City employee for minor <br />plats similar to the ones described above. The law states that the City may delegate to an <br />employee of the City the ability to approve 1) amending plats, and 2) minor plats involving <br />four or fewer lots fronting on an existing street and not requiring the creation of any new <br />street or the extension of municipal facilities. However, the designated employee may, for <br />any reason, elect to present the plat to the Planning and Zoning Commission for their <br />consideration. In addition, the designated employee shall not disapprove the plat and shall be <br />required to refer any plat, which he refuses to approve.to the Planning and Zoning <br />Commission within the time period specified elsewhere in the statutes. <br /> <br />Staff feels this would be a beneficial tool for both the developers and City staff. The <br />developers would be required to prepare the exact same documents as before, but scheduling <br />to meet with the Commission may not be required. Staff would continue to review all aspects <br />of the plat but may not be required to prepare an agenda and other material for presentation <br />to the Commission. <br /> <br />This matter was discussed during the October 15, 1998, Planning and Zoning Commission <br />meeting at which time the Commission directed staff to prepare an ordinance amendment for <br />consideration by City Council. <br /> <br />Action Required by Council: <br /> <br />Consider an amendment to Ordinance 1444 regulating the platting of land as it relates to <br />minor subdivisions and amending plats. <br /> <br />Availability of Funds: N/ A <br />General Fund <br />CapiUJI Improvement <br />Other <br />Account Number: <br /> <br />Water /W astewater <br />General Revenue Sharing <br /> <br />Funds Available: Yes <br /> <br />No <br /> <br />Council Agenda <br /> <br /> <br />to."., ~5 <br />Date <br />
