<br />_ <br /> <br />_ <br /> <br />UTILITY SERVICE TO INDUSTRIAL CUSTOMERS <br />OUTSIDE CITY LIMITS <br /> <br />BACKGROUND <br /> <br />Over the years, La Porte has received several requests for utility service, especially water, <br />from industries outside our City limits. In late 1982, because of requests and the need to <br />have a firmly established policy, the City developed a written policy, which was adopted <br />by Council in January 1983. The policy was essentially a "Good Neighbor" policy <br />designed to provide limited utility service to industrial customers. The policy established <br />minimum requirements for application of service, availability determination, line <br />extension requirements, special conditions for use of City utilities and approval of an <br />agreement by City Council. <br /> <br />In 1995, there were again, requests from industry for the City to provide water service. <br />Industry was responding to TNRCC regulations. Some industrial companies were hoping <br />to get out of the water business completely and the City received requests for service <br />ranging from 600 gallons per day (gpd) to 60,000 gpd. The City conducted surveys, <br />hosted meetings and ultimately adopted a policy that allowed for limited water service for <br />sanitary purposes. The City recognized that we could not deliver enough water to meet <br />the very high volume demands for process water. At that time, the City's available water <br />capacity was limited. The parameters of the current policy are: <br /> <br />. Company needs to have an Industrial District Agreement with the City of La Porte <br />. Company shall supply a statement of utility demands including: <br />average daily demand <br />peak day demand <br />minimum working pressure requirements <br />number of on-site employees <br />. Company shaH supply a site plan showing the total acreage of the tract including <br />present and proposed improvements <br />. City will determine availability of utilities based on the number of on-site employees <br />times an average daily demand of 50 gpd per employee. <br />. If adequate utilities are not available special provisions are considered including <br />extensions of the City's existing facilities, which requires approval of a separate <br />Utility Extension Agreement. <br />. Company may only use City water for human consumption, washing, etc., and at no <br />time use water for process of any sort without specific approval of City Council. <br />. All Company plumbing shall be permitted and shall meet applicable State and City <br />code requirements. City shall have the right to inspect any and all work related to the <br />furnishing of potable water to the Company. <br />. Company shall pay a one-time connection fee ofSl00.00 per employee, with a <br />minimum ofSS,OOO and a maximum ofS1S,000. <br />
