Ordinance <br /> <br />Summarv & Recommendation <br /> <br />Action taken in the latest legislative session resulted in two state law changes dealing with the <br />enforcement of Junked Motor Vehicles. The first change amends the definition of a Junked <br />Vehicle. The current definition shown in the City's Code of Ordinances, Chapter 34, Article V, <br />Sect. 34-166 describes the vehicle as: "Self-propelled and which is inoperative I!lllhas either an <br />expired license plate or inspection sticker ... . . ..". <br /> <br />The new legislative change amends that definition of a junked vehicle to read: "Self-propelled and <br />which is inoperative or has either an expired license plate or inspection sticker.. . ." <br /> <br />The second change adds language to Sect. 34-168. The new language addresses the relocation of <br />the vehicle and does not prohibit the city from continuing to work the violation. <br /> <br />If approved, these changes will allow staff to work a vehicle that may be operable but does not <br />have a current license plate/inspection sticker or has been wrecked or dismantled or relocated. <br /> <br />To keep city regulations consistent with state law and provide staff with an additional tool, staff is <br />requesting City Council adopt this change by approving an ordinance amending Chapter 34; <br />Article V, Sect. 34-166 and 34-168. <br /> <br />Action Reauired bv Council: <br /> <br />Consider approval of an ordinance amending Chapter 34, Article V, Sect. 34-166 & 34-168. <br /> <br />Availability of Funds: N/A <br /> <br />General Fund <br />Capital Improvement <br />Other <br /> <br />Water/Wastewater <br />General Revenue Sharing <br /> <br />Account Number: <br /> <br />Funds Available: Yes <br /> <br />No <br /> <br /> <br />Date <br /> <br />
