0 • <br />to be taken as necessary to remedy, alleviate, or remove any <br />substandard building found to exist; <br />(4) Issue orders or directives to any peace officer of the state, <br />including a sheriff, constable, or the chief of police, to enforce and <br />cant' out the lawful order or directives of the Commission; and <br />(5) Determine the amount and duration of the civil penalty the city may <br />recover as provided by Section 54.017 of the Texas Local <br />Government Article. <br />The provision of notice, the finality of Commission orders, and the duties <br />of the city attorney at Commission hearings shall be governed by the provisions <br />of this Article. <br />(b) In -the event a determination is made pursuant to subsection (a) above <br />that a building is in violation of this Article, the order issued with respect to the building <br />hereunder shall allow for no less than one hundred eighty (180) days to correct the <br />Violation if the owner of the building shows to the Commission or the Commission, as <br />applicable, that the owner <br />(1) Is disabled within the meaning of such term under Texas Property <br />Tax Article, Section 11.13(m), <br />(2) Is at least sixty-five (65) years of age, or <br />(3) Resides in the building with one (1) or more of the person's minor <br />children; <br />Provided that, the building giving rise to the order qualifies as the owner's lawful <br />homestead under applicable state law and the owner's annual family income is <br />considered "very low income," as such term is defined in 24 CFR Section 813.102 as <br />computed for the city for purposes of Section 8 of the United States Housing Act of <br />1937. A person so qualified may be represented at hearings by the person's duly <br />authorized representative, in the same manner as provided for other property owners. <br />This Section shall not be applicable in cases in which the Commission or the <br />Commission determines an imminent danger to health and safety exists with respect to <br />the applicable building. In addition, as soon as practicable following the issuance of an <br />order, the building official shall provide an owner qualifying under this subsection with <br />any available information regarding the availability of assistance for housing renovation <br />through the city's Planning Department. <br />Page 10 <br />
