Ordinance wI Exhibit "A" Authorizing <br />Execution of Special Warranty Deed <br /> <br />SUMMARY & UCOMMEND~TION <br /> <br />Mr. .Jade McCoy bas petitioned the City to vacate, abandon and close the alley in Block 1159, Town of La Porte. The <br />purpose of Mr. McCoy's request is to filcilitate future development of the block. In reviewing the closing request, the <br />Public Wades Department has determined that an abandoned 10" sanitary sewer line exists in the alley of the block. <br />This line was abandoned in conjunction with the East La Porte Relief Sanitary Sewer Project. All ftancbised utility companies have received noUfication of <br />the closing applkation and have responded to the applicant's request Reliant Energy, Southwestern BeIl8Dcl Time <br />Warner Communications have ead1 provided letters of no objection to the closing. <br /> <br />Additionally, the City owns a 5' x 20' tract out of Lot 17 that bad previously served as a portion ofa lift station site at <br />the south end of the block and bas subsequently been abandoned. Section 62-35(a)(l) of the Code of Ordinances gives <br />Council the right to waive standard bid and publication requirements for the sale or disposal of narrow, small or <br />otherwise unusable strips of land such as this. As a result, Staff has requested the City attorney to prepare a special <br />warranty deed to this tract to be executed at the time of passage and approval of the closing ontinance. <br /> <br />In accordance with Ordinance No. 98-2225, Staff has 3I'I'aIJged for an independent appraisal to be conducted of the <br />alley in question. As a result, the fair market value of the property has been assessed at $1.00 per square foot. The City <br />will be compensated in the amount of $4,800 for the alley (75% of Fair Market Value as per the ontinance) and <br />$100.00 for the City's 100 sqD8Ie foot tIact out of Lot 17 for a total of $4,900. <br /> <br />Recuunendatkta: <br />Staffrecommends closing, vacating, and abandoning the alley in Block 1159, Town of La Porte and providing for the <br />abandonment of an existing 10" sanitary sewer within the alley. Staff additionally recommends approval of a Special <br />Warranty Deed granting a 100 square foot tract out olLot 17, Block 1159 to Jack: McCoy. <br /> <br />Action Reauired by Cou:ndI: <br />Consider approval of two ordinances: the first of which to close, vacate, and abandon the alley in Block 1159, Town of <br />La Porte. Said ontiDance to also provide for the abandonment of an existing 10" sanituy sewer line located within the <br />alley.
