Broadway, La Porte, Harris County, TX by sales <br />respOndent Daigle on or about June 1, 1999. Nguyen does not remember whether Daigle <br />explained agency or provided Nguyen an Infoonation About Brokerage Services form. Daigle did <br />, provide Nguyen with a Seller's Disclosure (FO ., 1) and Muttlple Ustlng Service printout (FO ., 2). <br />· Daigle and Nguyen spent about an hour looking at'the property inside and outside of the buildings. <br />Although there was a City of La Porte Inspection sticker on the electric meter Indicating that the <br />electrical system was approved (FO # 3), there ~re no lights inside and they had to use DaIgle's <br />, flashlight because the windCMIS were boarded up. <br />fJ-1:>wl Co7n~;S-r:/~ <br />Nguyen noted at the time that the buildings were full of debris, there were numerous loose and <br />exposed electrical wires Inside and outside of the buildings. and that ceilings and walls were <br />severely damaged by apparent water penetration. Ngliyen has had extensive prior experience In <br />, "fIXer up. properties and believed that the buildings were within his capacity to repair and therefore <br />. did not require structural and mechanic:allns~ons.. <br /> <br />While examining the exterior of the property Daigle told Nguyen that the property had a 100' <br />frontage along S. Broadway and In depth It extendeqfrom a chain link fence in the rear of the <br />buildings 100' towards S. Broadway which would have placed the front edge of the property <br />approximately 5' to l' from the street surface, allowing ample parking space for the residence. <br /> <br />Nguyen submitted a purchase offer In Trinh's name which was accepted by the seller on June 8, <br />1999 (FO # 4) and the purchase closed at Alamo Title Co. on June 22, 1999 (FO" 5). Nguyen <br />then began to make the repairs necessary to convert the former commerclal property to residential <br />and to clean and repair the residential building. ~guyen removed the second stOlY structure of the <br />commercial building and while doing so was Infonned by Tommy Carpenter, a City of La Porte <br />building Inspector, that Nguye~ could not pa~ In front of the buildings, between the buildings and <br />the street, because that was county right of Way. This was contrary to what the Seller's Disclosure <br />indicated (FO # 6) and what Qj!igle had told Nguyen.
