AreaMap Budgeted Item: _YES ...x..NO SUMMARY & RECOMMlENDATION Mr. Nazar Momin (owner of Lots 1-12 and 19-32, Block 337, Town of La Porte) has submitted an application to the City to vacate, abandon and close the entire alley in Block 337, Town of La Porte. The purpose of his request is to consolidate his property to create a contiguous tract of land to facilitate future development Mr. Momin has procured Letters of Consent from the additional property owners of the block; Angelo Cucco (Lots 13-16) and EBC, Inc. (Lots 17 & 18). In reviewing the closing request, Staff has detennined that existing water, electricity, gas, telephone and cable facilities located within the alley must be either maintained in place, relocated and/or abandoned The applicant has coordinated with each of the City's fmnchised utility companies (i.e. Reliant Energy, Southwestern Bell & Time-Warner Communications) for the relocation of existing electrical, telephone and cable facilities from the nortbermnost 300' of the alley while maintaining current utility service to the remaining property owners by retaining a 16' utility easement along the southernmost 100' of the alley. The City's Public Works Department has detennined that the City's existing waterline can be cut, plugged and abandoned from the northenunost 300' of the alley without affecting additional services north of the block. In accordance with Ordinance No. 98-2225, Staff has arranged for an independent appraisal to be conducted for the rights-of-way in question. As a result, the fair marl<et value of the property has been assessed at $1.65 per square foot. The City has received compensation from the applicant for the entire alley (6,400 sq. ft.) in the amount of $7,920 (75% of fair market value per City ordinance). Recommendation: Staff recommends closing, vacating, and abandoning the entire alley in Block 337, Town of La Porte retaining a 16' utility easement for the southernmost 100' portion of the alley to be closed Action ReClluired bv Coulllcil: Consider approval of an ordinance to vacate, abandon and close the entire alley in Block 337, Town of La Porte; said ordinance to provide for dedication of a 16' utility easement to :filcilitate existing utility service to the southernmost 100' portion of the alley.
