<br />e <br /> <br />e <br /> <br />tax purposes for the preceding year. <br /> <br />Section 3. Voting Rights. Each Member shall have one (1) vote for each membership <br />interest owned by such Member. <br /> <br />Section 4. Multiple Ownership. Where more than one person or entity shall be at any <br />time the Owner of a Tract entitled to a membership interest, the vote attributed to such Tract <br />shall be exercised as such Owners mutually determine. No Member shall split or divide its votes <br />on any motion, resolution, ballot or otherwise. In the event that such Owners are unable to agree <br />among themselves as to how their yote or yotes shall be cast, they shall lose their right to yote on <br />the matter in question. If anyone of such Owners cast a vote, it will thereafter be conclusively <br />presumed for all purposes that such Owner was acting with the authority and consent of all other <br />Owners of the same Tract. In the event more than one yote is cast for a particular Tract by the <br />Owners of such Tract, none of said yotes shall be counted, but rather, all such yotes shall be <br />deemed yoid. <br /> <br />ARTICLE IV <br />PROPERTY RIGHTS IN THE DEVELOPMENT <br /> <br />Section 1. Title to Common Areas and Common Facilities. Declarant has or will haye <br />caused to be conyeyed to the Association legal title to the Flood Control Facilities, subject to the <br />rights and easements created or reserved in this Declaration. Additionally, the Declarant, by <br />execution of this Declaration, conveys all of Declarant's rights, title and interest in (a) the sign <br />easement cony eyed by that certain Special Warranty Deed (With Vendor's Lien) recorded under <br />Clerk's File No. Real Property Records, Harris County, Texas, which easement <br />is more particularly described by metes and bounds on Exhibit "B" thereof, and (b) the sign <br />easement reserved in that certain Special Warranty Deed recorded under Clerk's File No. <br />Real Property Records, Harris County, Texas, which easement is more particularly <br />described by metes and bounds on Exhibit " B" thereof. <br /> <br />Section 2. Easements. Declarant and the Owners do hereby giye, grant, and conyey to <br />the Association a non-exclusive easement, license, right and priyilege over any property within <br />the Deyelopment which now contains a sign or signs erected to identify the Subdivision with <br />reasonable rights of ingress and egress therefrom and thereto for purposes of construction, <br />repair, maintenance and replacement, and the maintenance and replacement of all landscaped <br />areas around said signs. If the entrance onto a Tract by the Association or its agents (pursuant to <br />the rights granted herein) should result in any damage to such Tract, to the extent that the <br />Association has funds available to do so, the Association agrees to repair such damage and <br />indemnify the Owner for any costs or expenses resulting therefrom. <br /> <br />ARTICLE V <br /> <br />5 <br />
