<br />e <br /> <br />e <br /> <br />time to time and shall be enforceable thirty (30) days after written notice thereof is sent to all <br />Owners. <br /> <br />ARTICLE IX <br />ENFORCEMENT <br /> <br />Section 1. Compliance by Owners. Eyery Owner, and all tenant and other occupants of <br />Tracts, shall comply with the covenants, restrictions, tenns and proyisions set forth in this <br />Declaration and all rules and regulation which from time to time may be adopted by the <br />Association. <br /> <br />Section 2. Failure to Comply. Failure of an Owner (or tenant or other occupant of <br />Tracts) to comply with such coyenants, restrictions, tenns, provisions of rules and regulation <br />shall be grounds for immediate action which may include, without limitation, an action to <br />recoyer sums due for damages, injunctiye relief, enforcement of other rights or remedies set <br />forth in this Declaration or any combination thereof. Any costs and reasonable attorney's fees <br />incurred by the Association shall be assessed against the non-complying Owner (of tenant or <br />other occupant of Tracts) and may be enforced as the personal obligation of the Owner Gointly <br />and severally with any said tenant or other occupant) and/or by a lien against the Tract in the <br />manner set forth in Article V of this Declaration. All rights and remedies of the Association <br />under this Declaration shall be cumulative and the exercise or non-exercise of any of same shall <br />not be deemed a waiver of that rights, or any other right. <br /> <br />ARTICLE X <br />GENERAL PROVISIONS <br /> <br />Section 1. Beneficiaries of Easements, Rights and Priyileges. The easements, licenses, <br />rights and privileges established, created and granted by this Declaration shall be for the Benefit <br />of, and restricted solely to, the Association and the Owners. Any Owner may also grant the <br />benefit of such easements, license, right or privilege to his tenants and guests for the duration of <br />their tenancies or yisits, subject in the case of the Common Areas or Common Facilities to the <br />rules and regulations of the Association. This provision is not intended, nor shall it be <br />construed, as creating any rights in or for the benefit of the general public. <br /> <br />Section 2. Duration and Amendment. <br /> <br />(a) The covenants and restrictions of this Declaration shall run with and bind the <br />Deyelopment and shall insure to the benefit of and be enforceable by the Association, any <br />Member or Owner of any land subject to this Declaration, their respectiye legal representatives, <br />heirs, successors and assigns until , 2046, unless otherwise expressly limited <br />herein, after which time said covenants and restrictions shall be automatically extended for <br />successive periods often (10) years unless an instrument signed by the Members holding not less <br />than seyenty-fiye percent (75%) of the yotes of the Association is filed of record and recorded in <br /> <br />12 <br />
