Labor purs=t to D_-vis-Bacon Act (401: S.C. 276a — 276a-5), to all laborers and <br />mechanics employe; in the development of any part of housing. Such contracts <br />must also Iz subjec: to the overtime provisions, as applicable, of the Contract <br />Work Hour_ and Safety Standards Act (4C U.S.C. 327 — .3 <br />1. "Se: Lion 3" Cause <br />a. Comr:iance <br />Cor_.pliance -ith the provisions c: Section 3 of the Housing and Urban <br />Devtlopmem Act of 1968, as amended, the regulations set forth in 24 <br />C.F.R. 135, aad all applicable rules and orders issued hereunder prior to <br />the executioz of this agreementshall be a condition of the federal <br />financial ass:.Lance provided under this Agreement and binding upon the <br />Grantee, the Subrecipient and any Subrecipient. Failure to fulfill these <br />requirements shall subject the G.-antee, the. Subrecipient and any sub- <br />Subrecipients. their successors and assigns, to those sanctions specified by <br />the Agreemez: through which federal assistance is provided, and as set out <br />in == C.F.R.--Subpart 0. The Surecipient certifies and agrees that no <br />contractual or other disability exists which would prevent compliance with <br />thes. require=ents. <br />The Subreciment further agrees to comply with these "Section 3" <br />regt_sements and to include the :ollowing language in all subcontract <br />executed uncle- this Agreement. <br />The :.ork to be performed under this contract is a project assisted <br />under : program providing iirect federal financial assistance from <br />HUD _rtd is subject to -tee requirements of Section 3 of the <br />Hous: and Urban Deve:rpment Act of 1968, as amended, 12 <br />U.S.0 1701.
