Reff John Jcerns <br />Chief of Police Acting City Manager <br />02/17/03 <br />Report to City Council <br />Information Collected on Traffic Citations and Arrests <br />Senate Bill 1074 upon becoming law became Texas Code of Criminal Procedure, Article <br />2.131 Racial Profiling Prohibited. Under this law, in Article 2.132 Law Enforcement <br />Policy on Racial Profiling, there is a requirement that all law enforcement agencies must <br />collect data "relating to traffic stops in which a citation is issued and to arrests resulting <br />from those traffic stops, including information relating to: <br />1. The race or ethnicity of the individual detained; and <br />2. Whether a search was conducted and, if so, whether the person detained <br />consented to the search. <br />Under Article 2.132 law enforcement agencies are required to report to their governing <br />agency, the City Council, the information collected for the previous year. The report <br />must be submitted prior to March 1, 2003 and must be for the period of January 1, 2002 <br />to December 31, 2002. <br />The information gathered for this report comes through the H.T.E. computer system of <br />the Municipal Court and Police System. On all citations during the past year officers <br />have been required to indicate whether a search was conducted and if the search was <br />consensual. The following is a compilation of that information from the H.T.E. system. <br />
