1, EXECUTION OF CONTRACT: The contract shall be signed and returned by the <br />successful offeror, together with certificates of insurance within ten (10) days, not <br />including Sundays, after the offeror has received notice that the contract has been <br />awarded. No proposal shall be considered binding upon the city until execution of <br />the contract. <br />Failure to execute a contract and file an acceptable bond, as provided herein, <br />within (10) days, not including Sundays, after the offeror has received notice that <br />the contract has been awarded, shall be just cause for the cancellation of the <br />award. <br />2. ASSIGNMENT: The Concessionaire shall not assign, transfer, convey, sublet or <br />otherwise dispose of the contract, or any part thereof, to any person, partnership, <br />company or corporation without prior written consent of the City of La Porte. <br />3. LAWS AND ORDINANCES: The Concessionaire shall procure all permits and <br />licenses, pay all charges and fees necessary and incidental to the due and lawful <br />conduct of the services. He shall keep himself fully informed of all existing and <br />future National, State and Local laws, ordinances and regulations that in any <br />manner affect the fulfillment of the contract andcomply with same. <br />Concessionaire shall obtain a mixed beverage license from the Texas Alcoholic <br />Beverage Commission, and keep such license in good standing during the term of <br />this Agreement. <br />Contractor will be responsible for any and all additions and/or changes in <br />equipment design and layout necessary to comply fully with local Health and Fire <br />Department regulations. Additional electrical service, plumbing or drain lines shall <br />be approved by the City of La Porte, prior to planning and installation. Actual <br />installation shall be according to all applicable State laws, regulations and <br />ordinances of City of La Porte. Concessionaire must also provide approved filters <br />for any and all exhaust systems that may be utilized or installed. <br />4. INDEMNIFICATION AGREEMENT: City and <br />"Indemnification Agreement" in form attached <br />herein, and made a part hereof for all purposes. <br />4 of 20 <br />Concessionaire shall enter into an <br />hereto, incorporated by reference <br />
