0 0 <br />City of La Porte as provided, and the Concessionaire will be credited with any <br />surplus remaining after all just claims for such completion have been paid. <br />In determination of the question whether there has been any such noncompliance <br />With the contract as to warrant the suspension of annulment thereof, the decision <br />of the City, with the approval of the City Council of the City of La Porte, shall be <br />binding upon all parties to the contract. <br />10. FACILITIES AND EQUIPMENT: Prospective offerors are invited to inspect, the <br />locations and equipment and may do so during working hours by contacting the <br />Golf Course Manager, Alex Osmond, at 281-471-4653. <br />Each offeror shall submit, with his bid, a complete list of equipment (required and <br />optional) he proposes to furnish for the concession operation, stating brand <br />names, model- numbers, quantity, year -of manufacturer and other identifying data <br />to properly outline his proposed operation layout. <br />Successful offeror shall have completed installation of all equipment, to include <br />new furniture both inside and outside the clubhouse, and be completely <br />operational no later than October 10, 2003. <br />The Concessionaire will be responsible for maintaining the assigned premises and <br />equipment in good repair and the replacement of .any equipment damaged or <br />missing through his operation. The cost of installing any new or added equipment, <br />when approved by the City of La Porte, will be bome by the Concessionaire and <br />such equipment will be his property. At the termination of the contract, the <br />Concessionaire may remove his own equipment, but will be responsible for leaving <br />the premises in their original state of repair, less normal wear and tear, or replace <br />or reimburse the city for any damaged or missing equipment assigned to him. This <br />will be done to the satisfaction of the City of La Porte, prior to releasing the <br />Concessionaire of his sureties from obligation. <br />Furniture used both inside and outside the clubhouse shall be replaced at least <br />every two (2) years or upon recommendation by the Golf Course Manager. <br />11. UTILITIES: Utility bills in connection with concession operation, excluding <br />telephone service, shall be the responsibility of the City. Concessionaire shall pay <br />to the City the sum of $500.00 per month, in addition to other money owed, for a <br />portion of the utilities. <br />6 of 20 <br />
