<br />.;1 <br />... <br /> <br />11.5.1 The Contractor shall furnish bonds covering faithful performance ofthe contract and <br />payment of obligations arising thereunder. Bonds may be obtained through the Contractor's <br />usual source with the required rating and the cost thereof shall be included in the Contract <br />Sum. <br /> <br />11.5.1.1 The Contractor shall deliver the required bonds to the Owner not later than <br />three (3) days following the date the Agreement is entered into, or if the work is to be <br />commenced prior thereto in response to a letter of intent, the contractor shall, prior to the <br />commencement ofthe Work, submit evidence satisfactory to the Owner that such bonds will <br />be furnished. <br /> <br />11.5.1.2 The Contractor shall require the attorney-in-fact who executes the required <br />bonds on behalf of the surety to affix thereto a certified and current copy of the power of <br />attorney. <br /> <br />Add Subparagraphs 11.5.3, 11.5.4 and 11.5.5: <br /> <br />11.5.3 Contractor shall provide a one-year maintenance on City of La Porte standard form <br />Document 00612, providing for the Contractor's correction, replacement, or restoration of <br />any portion of the Work which is found to be not in compliance with requirements of <br />Contract Documents during the one-year correction period required in Subparagraph 12.2.2. <br /> <br />11.5.4 Forms of Performance and Payment Bonds shall be as indicated in Documents 00610 <br />and 00611 and as mandated by the Texas Local Government Code, Texas Revised Civil <br />Statutes Annotated, Article 2253, for public projects. The contractor shall file copies of each <br />bond with the county clerk and furnish the Owner with a file receipt. The bonds shall remain <br />in force throughout the warranty period of the contract. They will not be started until the <br />bonds and issuing companies have been accepted as satisfactory by the Owner with an <br />authorized power of attorney attached.. <br /> <br />11.5.5 Claims must be sent to the Contractor and the Contractor's Surety in accordance <br />with Article 5160, Revised Civil Statutes. The Owner will furnish in accordance with such <br />Article, a copy of the Payment Bond as provided therein to claimants upon request. All <br />claimants are cautioned that no lien exists on the funds unpaid to the Contractor on such <br />Contract, and that reliance on notices sent to the Owner may result in loss of their rights <br />against the Contractor and/or its Surety. The Owner is not responsible in any manner to a <br />claimant for collection of unpaid bills, and accepts no such responsibility because of any <br />representation by any agent or employee. <br /> <br />Add Paragraph 11.6 as follows: <br /> <br />11.6 WORKER'S COMPENSATION INSURANCE COVERAGE <br /> <br />11.6.1 Comply with the requirements of Rule 28, T AC Section 110.110, Reporting <br />Requirements for Building or Construction Projects for Governmental Entities. <br /> <br />23 <br />
