4) Notifying the employee in the statement required by paragraph (3)(K)(1) that, as a condition <br />of employment under the grant, the employee will abide by the terms of the statement; and <br />Notify the employer in writing of his or her conviction for a violation of a criminal drug statute <br />occurring in the workplace no later than five calendar days after such conviction; <br />5) Notifying the Governor's Division of Emergency Management/State Administrative Agency <br />(GDEM/SAA), in writing, within 10 calendar days after receiving notice under subparagraph <br />3(K)(4), from an employee or otherwise receiving actual notice of such conviction. Employers <br />of convicted employees must provide notice, including position title, to GDEM/SAA. Notice <br />shall include the identification number(s) of each affected grant; <br />6) Taking one of the following actions, within 30 calendar days of receiving notice under <br />subparagraph 3(K)(4), with respect to any employee who is so convicted <br />a) Taking appropriate personnel action against such an employee, up to and including <br />termination, consistent with the requirements of the Rehabilitation Act of 1973, as <br />amended; or <br />b) Requiring such employee to participate satisfactorily in a drug abuse assistance or <br />rehabilitation program approved for such purposes by a Federal, State, or local health, <br />law enforcement, or other appropriate agency; <br />7) Making a good faith effort to continue to maintain a drug -free workplace through <br />implementation of paragraphs 1), 2), 3), 4), 5), and 6). (Federal Certification) <br />4. FAILURE TO COMPLY <br />GDEM/SAA may suspend or terminate sub -award funding, in whole or in part, or other measures may <br />be imposed for any of the following reasons: failing to comply with the requirements or statutory <br />objectives of federal law, failing to make satisfactory progress toward the goals or objectives set forth <br />in the sub -award application, failing to follow grant agreement requirements or special conditions, <br />failing to submit required reports, or filing a false certification or other report or document. <br />Satisfactory Progress is defined as accomplishing the following during the performance period of the <br />grant: deciding what purchases will be made, ordering the equipment, ensuring the equipment is <br />shipped and received, and training is accomplished with the equipment (or readied for deployment). <br />All of the aforementioned task must be accomplished in a timely manner. Special Conditions may <br />be imposed on sub -recipient's use of grant funds until problems identified during grant <br />monitoring visits conducted by GDEM audit and compliance personnel are resolved.. <br />5. CONFLICT OF INTEREST <br />The sub -recipient will establish safeguards to prohibit employees from using their positions for a <br />purpose that constitutes or presents the appearance of personal or organizational conflict of interest, <br />or personal gain. <br />6. LOBBYING <br />As required by Section 1352, Title 31 of the U.S. Code, and implemented at 28 CFR Part 69, for <br />persons entering into a grant or cooperative agreement over. $100,000, as defined at 28 CFR Part 69, <br />the sub -recipient certifies that: <br />2006 HSGP Terms and Conditions Page 4 of 9 <br />
