<br />or children's oriented eating establishment, as those terms are defined in <br />Article 481.134 of the Health and Safety Code of the State of Texas. <br /> <br />b) Penalties. Any person, firm or corporation who violates this ordinance <br />shall be guilty of a misdemeanor, and upon conviction thereof shall be <br />punished by a fine not to exceed FIVE HUNDRED AND NO/100'S <br />DOLLARS ($500.00). <br /> <br />SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby <br />repealed to the extent of the conflict only. <br /> <br />SECTION 3: If any part or portion of this ordinance shall be invalid or <br />unconstitutional, such invalidity or unconstitutionality shall not affect or impair any <br />remaining portions or provisions of this ordinance. <br /> <br />SECTION 4: Any person, firm, corporation, association or other entity that <br />violates this ordinance shall be subject to a fine of not more than $500.00 for each <br />violation. <br /> <br />SECTION 5: The City Secretary shall publish the caption of this ordinance within <br />ten days of final passage in the official newspaper of the City.
